1. General Guidelines

The Lebzelterei Karl Schmid offers both goods and services.
All sales, deliveries and other services are tailored to the specifics outlined in the General Business Guidelines. Counter-claims by the buyer in reference to his/her business and /or purchasing conditions are strictly discouraged.

2. Protection of Information

Your data will be protected under the terms of Austrian laws which protect personal and
credit information. Your data will only be used as needed for completing and carrying out
your order of goods and services.

3. Conditions of Use

Sales will only be made to adult and legally competent buyers. Minors are barred from ordering our wares and services. This includes the purchase of alcohol by people under the legal age to do so in their home countries. Purchases require authentic use of full names, addresses, ages, etc.
Prices are applicable to the day of ordering. All prices include value added tax of 10% (and up to 20%).

4. Concluding a Legally Binding Agreement

In making an order, the customer is entering into a legally binding purchasing contract.
The purchasing contract is confirmed through the written authorisation for the order of goods and/or services and through our confirmation of the order via e-mail.
We ask that repeat customers please contact us via e-mail.

5. Revocation and return right

The customer recalled the right the sales contract without indication of reasons within 14 days starting from receipt of the commodity too or the commodity to return. For keeping the punctual sending off of the revocation meets this period. It takes place then a back completion of the contract course around course.

If the commodity was already used and exhibits customs traces, the purchase can be recalled likewise only within the legal period by 14 days. We keep ourselves before the consumer the depreciation and the value of the use of the commodity to charge.

If the revocation does not concern goods in the value of any more than 40,-- Euro, then the buyer has to carry the back transmission costs, except those supplied commodity corresponds not to the ordered. 6. Terms of Ownership

Goods and products will remain under the ownership of the seller until such goods and products are paid in full.

7. Damaged or Defective Goods

Goods which are defective, or which have been damaged in transit, require that the buyer inform the Lebzelterei Karl Schmid with 7 (seven) days after delivery. Such information can be provided in writing, by telephone at +43 3148 272, or via e-mail to info@lebzelterei-schmid.at Late claims for damaged
Late claims for damaged goods will not be recognised. Buyers and customers should not accept or sign for any goods which clearly have been tampered with, or which have clearly been damaged during transit. If the products are delivered damaged, goods can be accepted or signed for under the condition that that seller is immediately informed of the situation.

8. Delivery and Payment

Shipping costs will automatically be calculated by our shop software.
The Order is payable per bank transfar befor delivery.

9. Returning Goods

The return of goods and products can only by carried out with the agreement of the seller and
requires that goods and products be sent directly to the buyer´s address. Products and goods must be returned in their entirety in the original packaging.
They must also be returned packed for transit in stable packaging, and must include the original bill of sale or a copy of the original bill of sale.

10. Liability

The Lebzelterei Karl Schmid is liable only for damage caused by intent or extreme negligence.
The Lebzelterei Karl Schmidis not liable for indirect or consequential damages, especially those involving a loss of profit, unless said damages were caused with intent or extreme negligence by workers, legal representatives, or employees of the seller.
Apart from the intent and extreme negligence caused by workers, legal representatives and employees of the seller, liability is limited to the costs of typical damage as foreseen with the closing of the purchasing contract.
The Lebzelterei Karl Schmid takes no liability for the constant and consistent access to the on-line shop, nor for any technical or electronic disruptions during the transmission of data.
The Lebzelterei Karl Schmid takes no liability for erroneous statements which occur as the result of technical or electronic defects, and reserves the right to cancel an purchasing orders made under such conditions.
Goods or services in which the price, amount or content given is blatantly and obviously a typographical error should, when in doubt, not be considered valid.

11. Altering the General Business Conditions

The Lebzelterei Karl Schmid reserves the right to change the General Business Conditions at any time and for any reason. Such changes will not apply to orders already in transit. Orders will be contingent on and correspond to the General Business Conditions applicable at the time the order was placed.

12. Legalities

These General Business Conditions fall under the jurisdiction of Austrian law.
Should the application of these legal requirements be inoperative and/or invalid, all other aspects and areas outlined under the General Business Conditions will remain valid and applicable.

Data Protection

We will process your personal data under the current Austrian laws protecting such data in order to carry out the contract of purchase. Data received from you (name, address, e-mail information, telephone numbers, means of payment, credit card data) will be held, processed, and applied to the extent they are needed for the grounds, organisation, or the alteration of the purchasing contract.
We maintain the right to use such data only to the extent of carrying out our rights and dutiesunder the terms of the purchasing contract.
We will also use such data in processing and using information related to consulting, advertising, market research, and in the organisation of our range of products.
